Betting Firm Ordered to Pay Former Employee Millions

A former employee of one of the leading betting firms has been ordered by the Employment and Labour Court to pay its former employee over Sh12.5 million.

Betika had asked the court to withhold two-thirds of former employee Fred Gitonga Njagi’s terminal dues of Sh12,562,575 after he was summarily dismissed from the betting company.

GIitonga was fired in 2022 over alleged fraud allegations.

Justice Jacob Gakeri declined to endorse the application by Shop & Deliver Ltd, also known as Betika saying.

“I find that withholding of Gitonga’s terminal dues by Betika was unjustifiable in law, and the avenue user to seek relief lacked the necessary anchorage.”

“The application is unsustainable and is accordingly dismissed with costs,” said the judge.

Gitonga was the head of technology at Betika. His salary was Sh1.9 million a month.

It is alleged that Gitonga stole Sh11 million from the Betika between January 13 and February 3, 2022.

Gitonga was arrested and charged at Milimani Chief Magistrate’s court where the case is still ongoing.

Betika fired Gitonga for gross misconduct after conducting internal investigations.

Betika was to pay Gitonga Sh12.5 million as terminal dues, but held Sh8.3 million, pending the conclusion of the criminal case.
