Shock As Court Stops NSSF Board From Holding Meetings

The Employment and Labour Relations Court of Kenyan has today, Tuesday, December 4, 2022 issued temporary orders stopping the National Social Security Fund (NSSF) Board from transacting any business.

The court said the orders would remain in force until a case filed by the Central Organization of Trade Unions (COTU) demanding the Labour CS gazettes the union’s nominee to the Board is determined.

In its orders, seen by Mwanahabari,  COTU listed the Cabinet Secretary Ministry of Labour and Social as the first respondent,  the Attorney General as the second respondent – and the board of trustees of the National Social Security Fund as the third respondent.

Among other prayers, COTU asked the court to certify the matter as urgent and deserving of hearing during the current vacation.

COTU  also wants the court to grant the applicant leave to apply for orders of mandamus directed to the first respondent to appoint and gazette applicant’s second nominee to the board of trustees of the National Social Security Fund.

The workers’ body also asked the honorable court to grant leave to the applicant to apply for an order asking the first and second respondents to stop/ and or restrain the first and second respondents by themselves agents or servants from convening any board meetings.

The court certified the matter as urgent – and proceeded to grant orders stopping the first and second respondents from convening any meetings until the case is heard and determined.

The hearing of the matter will be mentioned on January 17, 2022.
