A land broker who allegedly went underground for nine years after defrauding an Eldoret based businessman was finally arrested and arraigned in court.
Devan Ngosia Webi who looked composed in the dock, was charged with the businessman of Ksh1 million in a land deal.
Webi denied the charges before Eldoret Chief Magistrate Linus Kassan.
He was accused of falsely pretending to be in a position to sell to Zeki Wanjala Wafula a land parcel in pioneer/Langas block 1/164 measuring ¼ to the complainant, a fact he knew to be false.
The court was told that the accused unlawfully obtained from the complainant Ksh 1 million by falsely pretending that he was in a position to sell him the plot which police detectives later established that he did not own.
The accused allegedly committed the said offence on the May 1, 2013 at Eldoret town, in Uasin Gishu County.
After signing the sale agreement with the complainant at the law firm of Isaac Terer in Eldoret town upon receiving Ksh 1 million, the accused then allegedly told Wafula to go to the site and fence his plot.
Wafula told the court that when he arrived at the said plot, he met a group of armed youth who chased him away while baying for his blood.
The complainant later discovered that he had been sold a non-existent plot forcing him to report to the police.
The officers, attached to the directorate of criminal investigations department arrested the accused in Nairobi after nine years on the run.
The accused had allegedly forged title deeds and purported to be the owner of the plot whereas he knew the prime plot did not belong to him.
The magistrate ordered the accused to be released on a personal bond of Ksh 100,000.
The case is set for mention on June 16.
