President Uhuru Kenyatta has appointed 34 judges in a special gazette notice issued on Thursday, June 3.
The Judicial Service Commission had forwarded 41 names to President Kenyatta but one of the jurists died in 2020.
Six of the judicial officers whose appointments were rejected include George Odunga and Joel Ngugi, both of who were among the 5-judge bench that nullified the Building Bridges Initiative.
Others who were rejected include Weldon Korir, Aggrey Muchelule, and two others.
The decision to exclude Odunga and Ngugi has sparked debate from the legal fraternity as well as other Kenyans.
The names of the six judges have been referred back to the JSC, with President Kenyatta saying they did not meet the threshold for appointment.
